In consideration of being allowed to enter and use the facilities located at 328 Green Bay Road, Highwood, IL 60040 and participate in any activity or program offered by JN Ventures, LLC dba Giggles Play (hereafter referred to as "Giggles Play"), I, on my own behalf and on behalf of my child(ren) identified below, acknowledge, appreciate, and agree to the following:
Assumption of Risk: I acknowledge and agree that there are inherent risks associated with the use of the facilities and participation in any activity or program at Giggles Play. Such risks include but are not limited to falling, bumping, risks from abrasions, scrapes, cuts, broken, sprained or bruised limbs, and even serious injuries such as paralysis or death, as well as risk from the actions or omission of others. I acknowledge that I am aware of the risks involved in using the facilities and participating in any activity or program at Giggles Play and assume all such risks, known and unknown.
Release and Waiver of Liability: I hereby release, waive and forever discharge Giggles Play, its members, managers, affiliates, agents, employees, contractors, successors, and assigns from any and all claims, demands, damages, actions, or causes of action, resulting from or arising out of my use of the facilities or participation in any activity or program at Giggles Play, including but not limited to any claims for personal injury, property damage, wrongful death, or any other loss.
Indemnification: I agree to indemnify and hold harmless Giggles Play, its members, managers, affiliates, agents, employees, contractors, successors, and assigns from and against any and all injuries, illnesses, medical conditions, damages, claims, liabilities, expenses or judgments, including attorney's fees and court costs resulting from any negligent or deliberate act or omission of my child(ren), caregiver or myself.
Code of Conduct: I acknowledge and agree to abide by all posted safety signs, rules, and verbal instructions as conditions for using the facilities and participating in any activity or program at Giggles Play. I further acknowledge that any inappropriate behavior, such as, but not limited to, harassment, physical or health endangerment of self or another person, or foul language will result in the immediate removal from the premises.
Personal Property: I understand and acknowledge that I am solely responsible for any personal property brought onto the premises of Giggles Play, and that Giggles Play shall not be liable for any loss, damage or theft of such personal property. I acknowledge that I am responsible for ensuring the safekeeping of my personal property while on the premises of Giggles Play, and that Giggles Play shall not be held responsible for any damage, loss or theft of such personal property under any circumstances.
Certification and Consent: I certify that I am the parent or legal guardian of the child(ren) whose name(s) appear(s) below, or have obtained permission from the parent/legal guardian of the participant(s) named above to execute this agreement on their behalf, and I have the authority to waive rights on behalf of the minor child(ren). I understand that this is a permanent waiver to be kept on file by Giggles Play for today's visit and all subsequent and future visits. I have informed myself on the contents of this Waiver from Giggles Play and hereby release from liability and indemnify Giggles Play after reading and signing this agreement.
Media Release
I understand that Giggles Play may take photographs or videos of my child(ren) while on the premises or participating in any activity or program offered by Giggles Play. I hereby grant permission to Giggles Play and its agents to use my or my child's photograph or video publicly to promote Giggles Play. I understand that the images may be used in print publications, online publications, presentations, websites, and social media. I also understand that no royalty, fee, or other compensation shall become payable to me by reason of such use. However, I acknowledge that Giggles Play will not disclose any personally identifiable information, such as names or addresses, without my express written consent.
